Terms of Sale & Pricing Disclaimer

AI summary

AI-written reading aid: an overview of this policy. The full policy below is the authoritative text.

  • Listed prices are automated blended estimates from third-party appraisals, not firm offers; displaying a price or starting a checkout creates no contract.
  • A binding agreement forms only when the seller expressly approves the price and transaction terms — inside Escrow.com, or for a Stripe monthly plan by confirming domain, total and installments; you may decline.
  • Escrow.com holds funds; Stripe is not escrow — you authorize the first charge and automatic monthly charges, and ownership stays with the seller until fully paid.
  • If the seller declines an erroneous transaction, Escrow.com refunds under its procedures, or the seller stops collections and refunds through Stripe, timed by Stripe and your bank.
  • Approval or refusal rests solely on the correctness of price and terms, applied uniformly; a declined deal gives no right to the mistaken price.
  • Prices carry no warranty and liability is limited as far as law allows; Irvine, California courts handle disputes unresolved through the payment provider; mandatory consumer and card-dispute rights remain; questions to legal@namegarage.com.

1. How prices are produced

Listed prices are generated automatically. For each domain, the figure is a blended estimate derived from independent third-party appraisal services (currently Atom.com, agent.ai, and GoDaddy GoValue) combined by an automated pricing routine. Domains for which no external appraisal is available are shown as make-an-offer only, with no listed price.

Because this process is automated and depends on external data, listed figures can be wrong — through data-feed errors, synchronization delays, service outages, software defects, or accidental data-entry ("fat-finger") mistakes. A listed figure is therefore an invitation to treat (an invitation for you to make an offer), not a firm offer capable of acceptance. Displaying a price, accepting an inquiry, or a buyer beginning a checkout does not by itself create a contract.

2. When a binding agreement is formed

A binding agreement is formed when the seller expressly approves the price and transaction terms. For an Escrow.com transaction, that approval takes place within Escrow.com. For a Stripe monthly card plan, the seller confirms the agreed domain, total price and installment schedule with the buyer. A payment or a checkout receipt alone is not seller approval. If the seller-approved terms differ from a website estimate, the buyer is free to decline them.

3. Sale and approval process

The buyer expresses interest, makes an offer or starts a checkout. The seller reviews the price and terms for the errors described in Section 1. Approval or refusal follows the good-faith rule in Section 4.

Escrow.com transactions

Escrow.com holds the buyer's funds and runs its own identity, funding and transfer process. The transaction stays non-binding until the seller approves it in Escrow.com. If the seller declines an erroneous transaction, Escrow.com returns the funds under its procedures. After approval and confirmed funding, the seller transfers the domain under Escrow.com's process.

Monthly card payments through Stripe

Stripe processes payments directly for the seller; Stripe is not an escrow service. The checkout shows the total price, any down payment, the first installment and the remaining monthly amounts. By accepting the card-plan authorization, the buyer authorizes the first charge at checkout and automatic monthly charges for the displayed remaining schedule. The first charge includes any down payment and the first installment. The seller pays Stripe's processing and billing fees; they are not added as a full-term fee charged to the buyer upfront.

After the first payment and seller verification, the seller arranges domain access with the buyer. Ownership remains with the seller until the entire agreed price is paid. Final transfer is handled by the seller after reviewing the payments, refunds and disputes. A failed payment, refund, dispute or stopped collection requires seller review before further fulfillment; a successful payment receipt is not confirmation that ownership transferred.

If the seller declines a plan because its price or terms reflect an error, the seller stops future collections and refunds the amount paid through Stripe. These payments are not held in escrow, and refund processing follows Stripe's and the buyer's bank's timing. Contact legal@namegarage.com to discuss a payment problem or a request to stop future collections.

4. Good faith and equal treatment

The seller's decision to approve or decline a transaction is based solely on the correctness of the price and transaction terms. That decision is applied uniformly and without regard to the identity, location, nationality, business, or any other characteristic of the buyer. The seller does not use the verification step to discover a buyer's identity and then raise the price on that buyer: where the seller identifies a listing error, the seller will decline the affected transaction and, where practical, correct the listed price for all prospective buyers rather than re-quote a higher price to a particular buyer. A declined transaction does not entitle the buyer to demand the erroneous price, and the seller is under no obligation to sell at a price it has identified as mistaken.

5. No warranty; "as is" pricing

ALL LISTED PRICES, VALUATIONS, AND LEASE RATES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. THE SELLER DOES NOT WARRANT THAT ANY LISTED PRICE IS ACCURATE, CURRENT, OR ERROR-FREE.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SELLER AND ITS AFFILIATES, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO ANY PRICING INACCURACY, ALGORITHMIC OR DATA ERROR, SYSTEM FAULT, OR DECLINED OR CANCELLED TRANSACTION. BY USING THIS WEBSITE OR INITIATING A TRANSACTION, THE BUYER WAIVES ANY RIGHT TO ENFORCE A DISPLAYED PRICE THAT THE SELLER HAS NOT EXPRESSLY APPROVED UNDER SECTION 2. THE SELLER'S TOTAL LIABILITY FOR ANY DISPUTED TRANSACTION IS LIMITED TO THE AMOUNT, IF ANY, THE SELLER ACTUALLY RECEIVED FROM THE BUYER FOR THAT TRANSACTION.

7. Governing law and disputes

These Terms, and any dispute arising from them or from any transaction described here, are governed by the laws of California, United States, without regard to its conflict-of-laws rules. The parties submit to the courts of Irvine, California for any dispute not resolved through the selected payment provider's process. Nothing in these Terms removes any mandatory consumer right or the right to raise a card-payment dispute with the buyer's bank.

8. General
