Terms of Sale & Pricing Disclaimer: what changed

v2.0 · 2026-09-27 to v4.1 · 2026-10-16

AI summary

AI-written reading aid: changes between these versions. The linked published versions are the authoritative text.

  • Adds Stripe monthly card plans beside Escrow.com, with disclosed first charge, automatic monthly charges, seller-paid fees and refunds where a plan is declined.
  • Adds formation, availability and reservation rules: binding sale needs approval plus a confirmed qualifying payment or deposit; the first such payment reserves the domain.
  • Clarifies that offers, card authorizations and "Awaiting Payment" status reserve nothing, and adds "already reserved or sold" as a decline ground.
  • Adds listing of completed sales showing domain, month, price and venue without identifying the buyer, removable or price-free on request.
  • States transaction-specific agreed terms prevail and that changes do not retroactively amend existing agreements.
  • Routes unresolved disputes through the selected payment provider's process before Irvine courts, preserving consumer and card-dispute rights.

2. WhenFormation, availability and reservations For transactions governed by these Terms, acceptance of an offer or approval of a bindingprice agreementbefore funding is formed conditional on continued availability. A binding sale agreement is formed onlyarises when, and on the terms on which, the seller expresslyhas approvesapproved the transaction withinterms Escrow.comand the funding condition below has been satisfied for that transaction. The bindingagreed price and payment schedule are exclusivelythose expressly approved for the transaction, not an unconfirmed website estimate. The buyer may decline those terms before proceeding. Domains remain available to other buyers until the required payment or an agreed reservation deposit has been received and confirmed. Submitting or accepting an offer, agreeing on a price, creating an Escrow.com transaction, signing an unpaid agreement governed by this condition, or receiving payment instructions does not by itself reserve a domain. An “Awaiting Payment” status, selecting a payment method, a card authorization, or saying that payment has been sent does not establish a reservation. For Escrow.com purchases, a reservation begins when Escrow.com confirms receipt of the payment required at that stage of the agreed transaction, even while its payment verification is pending. For an agreed deposit or direct payment, receipt of the required amount must be confirmed by the designated payment provider or by the seller through the agreed payment method. An unsolicited or insufficient payment does not create a reservation. For monthly card plans, the required initial payment is the first charge disclosed in Escrowthe plan, including any agreed down payment and first installment.com —A card authorization alone is not any number displayed on this websitereceipt. Before reservation, the seller approvesmay governscontinue marketing the domain and considering other buyers. After reservation, the domain is reserved for that transaction until completion or verified resolution under its agreed terms. Receipt of funds does not itself authorize domain transfer: payment verification and other agreed completion requirements still apply. If competing payments arrive, only one transaction can receive the domain. The first qualifying payment confirmed and recorded by the seller’s reservation process establishes the reservation. Payment for a domain already reserved for another transaction is handled through the applicable cancellation or refund process. These Terms create no general right to declineforfeit ita deposit. Transaction-specific terms expressly agreed by both parties prevail where they differ from these Terms. The seller's decision to approve or decline a transaction is based solely on the correctness of the price and transactionterms termsand the domain’s availability under the reservation rules. ThatThose decisioncriteria isare applied uniformly and without regard to the identity, location, nationality, business, or any other characteristic of the buyer. The seller does not use the verification step to discover a buyer's identity and then raise the price on that buyer: where the seller identifies a listing error, the seller will decline the affected transaction and, where practical, correct the listed price for all prospective buyers rather than re-quote a higher price to a particular buyer. A declined transaction does not entitle the buyer to demand the erroneous price, and the seller is under no obligation to sell at a price it has identified as mistaken.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SELLER AND ITS AFFILIATES, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO ANY PRICING INACCURACY, ALGORITHMIC OR DATA ERROR, SYSTEM FAULT, OR DECLINED OR CANCELLED TRANSACTION. These Terms, and any dispute arising from them or from any transaction described here, are governed by the laws of California, United States, without regard to its conflict-of-laws rules. The parties submit to the courts of Irvine, California for any dispute not resolved through Escrow.comthe selected payment provider's ownprocess. Nothing in these Terms removes any mandatory consumer right or the right to raise a card-payment dispute processwith the buyer's bank. 8.
