Terms of Sale & Pricing Disclaimer

AI summary

AI-written reading aid: an overview of this policy. The full policy below is the authoritative text.

  • Listed prices are automated estimates that can be wrong; they invite offers and do not form a contract, even if you start checkout.
  • A sale binds only after seller approval of the terms and confirmed funding; you may decline approved terms, and the domain stays available to others until qualifying payment.
  • The seller decides based on correct price, terms and availability, applied uniformly regardless of buyer identity, and corrects errors for everyone rather than re-quoting you higher.
  • On new Stripe card plans, the seller keeps ownership until full payment; you may cancel unpaid plans in writing, request fee-free payoff quotes, and cure missed payments after notice.
  • Prices carry no warranty, and liability is limited to the extent law permits; mandatory consumer rights and card-payment disputes with your bank remain.
  • California law applies, with Irvine courts for disputes unresolved by the payment provider's process. Completed sales may be listed without naming you; contact legal@namegarage.com to omit price or listing.

1. How prices are produced

Listed prices are generated automatically. For each domain, the figure is a blended estimate derived from independent third-party appraisal services (currently Atom.com, agent.ai, and GoDaddy GoValue) combined by an automated pricing routine. Domains for which no external appraisal is available are shown as make-an-offer only, with no listed price.

Because this process is automated and depends on external data, listed figures can be wrong — through data-feed errors, synchronization delays, service outages, software defects, or accidental data-entry ("fat-finger") mistakes. A listed figure is therefore an invitation to treat (an invitation for you to make an offer), not a firm offer capable of acceptance. Displaying a price, accepting an inquiry, or a buyer beginning a checkout does not by itself create a contract.

2. Formation, availability and reservations

For transactions governed by these Terms, acceptance of an offer or approval of a price before funding is conditional on continued availability. A binding sale agreement arises when the seller has approved the transaction terms and the funding condition below has been satisfied for that transaction. The agreed price and payment schedule are those expressly approved for the transaction, not an unconfirmed website estimate. The buyer may decline those terms before proceeding.

Domains remain available to other buyers until the required payment or an agreed reservation deposit has been received and confirmed. Submitting or accepting an offer, agreeing on a price, creating an Escrow.com transaction, signing an unpaid agreement governed by this condition, or receiving payment instructions does not by itself reserve a domain. An “Awaiting Payment” status, selecting a payment method, a card authorization, or saying that payment has been sent does not establish a reservation.

For Escrow.com purchases, a reservation begins when Escrow.com confirms receipt of the payment required at that stage of the agreed transaction, even while its payment verification is pending. For an agreed deposit or direct payment, receipt of the required amount must be confirmed by the designated payment provider or by the seller through the agreed payment method. An unsolicited or insufficient payment does not create a reservation.

For monthly card plans, the required initial payment is the first charge disclosed in the plan, including any agreed down payment and first installment. A card authorization alone is not receipt. The domain remains available until the payment processor confirms receipt and the reservation process records the qualifying payment.

A quote states a price for its stated validity period; it does not guarantee continued availability. Before reservation, the seller may continue marketing the domain and considering other buyers. After reservation, the domain is reserved for that transaction until completion or verified resolution under its agreed terms. Receipt of funds does not itself authorize domain transfer: payment verification and other agreed completion requirements still apply.

If competing payments arrive, only one transaction can receive the domain. The first qualifying payment confirmed and recorded by the seller’s reservation process establishes the reservation. Payment for a domain already reserved for another transaction is handled through the applicable cancellation or refund process. An agreed deposit’s amount, duration, credit toward the price, and refund or forfeiture conditions must be disclosed and agreed before payment. These Terms create no general right to forfeit a deposit.

Transaction-specific terms expressly agreed by both parties prevail where they differ from these Terms. Escrow.com’s agreement and procedures govern its services. This version does not retroactively amend an existing agreement or give the seller a new right to cancel one.

3. Sale and approval process

  1. Buyer inquiry / intent. The buyer expresses interest, makes an offer, or starts checkout based on a non-binding estimate.
  2. Transaction terms. Escrow.com purchases use its agreed transaction terms and procedures. Direct purchases use the purchase agreement for the selected payment method. Escrow.com holds escrow payments; the seller receives direct payments through the agreed method.
  3. Seller verification. The seller verifies the price, terms and availability. Approval before funding is conditional on continued availability under Section 2.
  4. Seller decision. A transaction may be declined for a pricing or terms error, or because the domain is already reserved or sold. Cancellation and any return of money follow the applicable transaction terms and payment provider’s procedures. An unpaid checkout is not an exclusive reservation.
  5. Completion. Following approval, a qualifying reservation and required payment verification, the domain is transferred under the agreed process. Funds received but still under verification reserve the domain; they do not authorize its transfer.

Monthly card payments through Stripe

Stripe processes payments directly for the seller; Stripe is not an escrow service. The checkout shows the total price, any down payment, the complete payment schedule, including the amount due today, every monthly amount, the final payment and the total to own. By accepting the card-plan authorization, the buyer authorizes the first charge at checkout and automatic monthly charges for the displayed remaining schedule. The first charge includes any down payment and the first installment. The seller pays Stripe's processing and billing fees; they are not added as a full-term fee charged to the buyer upfront.

After the first payment and seller verification, the seller arranges domain access with the buyer. Ownership remains with the seller until the entire agreed price is paid. Final transfer is handled by the seller after reviewing the payments, refunds and disputes. A failed payment, refund, dispute or stopped collection requires seller review before further fulfillment; a successful payment receipt is not confirmation that ownership transferred.

If the seller declines a plan because its price or terms reflect an error, or because another qualifying payment reserved the domain first, the seller stops future collections and refunds the amount paid through Stripe. These payments are not held in escrow, and refund processing follows Stripe's and the buyer's bank's timing. Contact legal@namegarage.com to discuss a payment problem, cancellation or an early-payoff quote.

Monthly schedules and the final payment

The agreed schedule separates the cash price, fixed payment-plan surcharge, any Easy Start surcharge and the total required to acquire ownership. A surcharge is included in the payments shown; it does not start accruing after an interest-free period. A flat surcharge is not an annual percentage rate. These descriptions do not replace any disclosure required by applicable law.

Easy Start lowers the opening payments and increases the later payments. A balloon schedule instead lowers the regular payments and leaves a larger required final payment. Where offered, a balloon schedule has no down payment, no Easy Start and no extra balloon surcharge. Its final-payment percentage is a target based on the cash price; whole-dollar allocation can increase the actual final amount. The displayed final amount, not the target percentage, is part of the agreed schedule. A bundle adds each domain's allocated schedule. The final payment is required to acquire ownership; it is not a separate optional purchase price.

Today's charge is the first payment slot, including any down payment. The first automatic payment is one calendar month after the successful first payment, clamped to that month's last day. It sets the monthly billing day for later payments. A final payment in slot 24 falls 23 monthly billing intervals after the first payment. The provider's schedule supplies the calendar dates once the first payment establishes that billing day. All required payments, including the final payment, must be confirmed before the seller reviews final ownership transfer.

The seller arranges domain access after the initial payment and verification and retains registration control until completion. Domain use must comply with law and the agreed terms. Contact the seller to arrange DNS changes, confirm registration coverage or request an early-payoff quote. No extension or refinancing is promised. A changed schedule requires new agreed terms and buyer confirmation.

Cancel an unpaid card plan

For a new card agreement that accepts this version, the buyer may cancel at any time while the purchase remains unpaid. Send a written cancellation request to legal@namegarage.com from the agreement's buyer email address. The seller verifies the buyer's request and records when it was received. Cancellation takes effect when the seller receives the valid request; it does not require seller approval, a missed payment or a grace period. The buyer must stop using the domain and give up any access or control supplied under the lease. The seller keeps ownership and recovers control. Cancellation does not transfer ownership to the buyer.

The seller stops future collection and does not charge a cancellation fee, accelerate or collect any unpaid purchase balance, including an unpaid final payment. Payments completed before receipt of the cancellation request are retained, subject to mandatory law and the exceptions below. A charge completed after receipt is reviewed for correction or refund; it is not automatically retained and does not restart the agreement. If the available timestamps cannot establish whether payment preceded the request, that payment also requires review. Processing a request may take time, but it does not move the effective cancellation time or make later purchase payments owed.

Billing closure and domain return require the verification described below. An unresolved payment, refund, dispute or domain-control issue keeps the reservation protected for review. It does not create a right to continue collecting the unpaid purchase balance. Once full payment or a confirmed early payoff completes the purchase, ownership-transfer and payment-review procedures apply; this cancellation process cannot convert a completed purchase into retention of both the full price and the domain. Mandatory withdrawal and refund rights remain unaffected.

Pay off a new card plan early

The buyer may contact the seller for an early-payoff quote on an eligible new card plan. The quote credits confirmed payments and removes the payment-plan and Easy Start surcharges allocated to payment periods that have not started. No early-payoff fee applies. The seller shows the exact payoff amount, credited payments and fee reduction for the buyer's confirmation before payment. Unresolved missed payments, refunds, disputes or other payment issues require review before the seller can issue a payable quote.

Each domain's agreed cash price and actual surcharge amounts are frozen when the plan is accepted. Each surcharge is allocated evenly across that domain's scheduled payment periods. The first period starts when the first payment succeeds; each later period starts on its scheduled installment date. To account for cent rounding, the earned share of each surcharge is its total multiplied by the number of periods started, divided by the total number of periods, rounded half up to cents. The rest is removed from the payoff. This calculation is made separately for each domain and surcharge before adding the results. It is not daily interest or a new annual percentage rate.

The payoff equals the original total less confirmed payments and the remaining future surcharges. A down payment is credited once as part of the actual payments. The original schedule and payment history stay recorded; a fee reduction is not money received or a cash refund. Ownership transfer still requires verified payment, closure of the remaining collection paths and seller review. Existing agreements without this expressly accepted payoff basis keep their original terms.

Missed payments, notice and domain return

For new monthly card agreements accepted under this version, a missed payment, including the final payment, triggers a default notice to the buyer's agreed email address. The seller records when the sending service first accepts the notice for that installment. Service acceptance is not proof of inbox delivery. A failed sending attempt does not start the notice-based grace period. The cure deadline is no earlier than both the installment due date plus 14 calendar days and the first accepted notice plus 14 calendar days. A later missed installment needs its own notice and full grace period. The buyer can cure the missed payment before termination; contact the seller for payment recovery.

If the missed payment remains uncured after that deadline, the seller may stop collections and terminate domain use. The seller must verify that the payment schedule and any unpaid invoices can no longer collect, check payments, refunds and disputes, and confirm control of every domain before completing return and releasing the reservation. A billing cancellation or webhook alone does not prove domain return or authorize relisting. Uncertain payments or control require review.

After verified termination, the buyer loses domain use, the seller recovers control, and the seller retains prior payments subject to applicable law and the exceptions below. The seller does not accelerate, pursue or collect any remaining purchase balance, including an unpaid final payment. The original schedule and payment records remain in the agreement history; they do not establish a collectible balance after termination. Retaining prior payments is not a refund.

Payment retention does not override mandatory rights, refunds required for seller nonperformance, the price-error or competing-reservation refund above, or corrections for erroneous, fraudulent, disputed or charged-back payments. These cases require review under the applicable agreement, law and provider process. A late or duplicate payment does not restart an ended agreement and must be reviewed separately for correction or refund. Nothing here limits a buyer's right to raise a payment dispute.

These provisions apply only to new agreements that expressly accept this version and its payment authorization. Existing plans keep their agreed schedule, authorization, cancellation and payoff terms. Escrow.com transactions follow Escrow.com's own agreement and procedures, not these card-plan default rules.

4. Good faith and equal treatment

The seller's decision to approve or decline a transaction is based on the correctness of the price and terms and the domain’s availability under the reservation rules. Those criteria are applied uniformly and without regard to the identity, location, nationality, business, or any other characteristic of the buyer. The seller does not use the verification step to discover a buyer's identity and then raise the price on that buyer: where the seller identifies a listing error, the seller will decline the affected transaction and, where practical, correct the listed price for all prospective buyers rather than re-quote a higher price to a particular buyer. A declined transaction does not entitle the buyer to demand the erroneous price, and the seller is under no obligation to sell at a price it has identified as mistaken.

5. No warranty; "as is" pricing

ALL LISTED PRICES, VALUATIONS, AND LEASE RATES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. THE SELLER DOES NOT WARRANT THAT ANY LISTED PRICE IS ACCURATE, CURRENT, OR ERROR-FREE.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SELLER AND ITS AFFILIATES, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO ANY PRICING INACCURACY, ALGORITHMIC OR DATA ERROR, SYSTEM FAULT, OR DECLINED OR CANCELLED TRANSACTION. BY USING THIS WEBSITE OR INITIATING A TRANSACTION, THE BUYER CANNOT ENFORCE A DISPLAYED PRICE AS A BINDING SALE AGREEMENT UNLESS THE APPROVAL AND FUNDING CONDITIONS IN SECTION 2 ARE SATISFIED, SUBJECT TO THE EXPRESSLY AGREED TRANSACTION-SPECIFIC TERMS. THE SELLER'S TOTAL LIABILITY FOR ANY DISPUTED TRANSACTION IS LIMITED TO THE AMOUNT, IF ANY, THE SELLER ACTUALLY RECEIVED FROM THE BUYER FOR THAT TRANSACTION.

7. Governing law and disputes

These Terms, and any dispute arising from them or from any transaction described here, are governed by the laws of California, United States, without regard to its conflict-of-laws rules. The parties submit to the courts of Irvine, California for any dispute not resolved through the selected payment provider's process. Nothing in these Terms removes any mandatory consumer right or the right to raise a card-payment dispute with the buyer's bank.

8. Listing completed sales

After a sale completes, we may list the domain name, the month of the sale, the price and where it sold on namegarage.com. We never name or identify the buyer. Ask us at any time, before or after the sale, to list it without the price or not at all, and we will update the listing promptly.

9. General

Acceptance. By browsing this website, submitting an offer, or initiating a transaction, you acknowledge that you have read and agree to these Terms.

Severability. If any provision of these Terms is held unenforceable, the remaining provisions stay in full effect.

Entire terms; changes. These Terms and the transaction-specific terms expressly agreed by both parties govern website pricing, approval, availability, reservations and the listing of completed sales. Expressly agreed transaction-specific terms prevail where they differ; Escrow.com’s agreement governs its services. Together, the applicable terms supersede prior statements on these subjects for that transaction. Changes to these website Terms do not retroactively change an existing agreement. Each revision is published as a new dated version, and prior versions remain available in the version history.
