Terms of Sale & Pricing Disclaimer: what changed
AI summary
AI-written reading aid: changes between these versions. The linked published versions are the authoritative text.
- Adds a section allowing completed sales to be listed with domain, month, price and venue, never naming the buyer; buyers may ask to omit the price or the listing.
- Expands Stripe checkout disclosure to the complete schedule and adds rules on fixed surcharges (not an annual percentage rate), Easy Start, balloon final payments and billing dates.
- Adds written cancellation of an unpaid new card plan, effective on receipt, with no fee or balance collection; the seller keeps ownership and prior payments, subject to law and review exceptions.
- Adds fee-free early-payoff quotes and missed-payment rules: notice, a cure deadline at least 14 days after both due date and notice, then verified termination without collecting the remaining balance.
- Limits these card-plan rules to new agreements accepting this version; existing plans and Escrow.com transactions keep their own terms.

Stripe processes payments directly for the seller; Stripe is not an escrow service. The checkout shows the total price, any down payment, the firstcomplete installmentpayment schedule, including the amount due today, every monthly amount, the final payment and the remainingtotal monthlyto amountsown. By accepting the card-plan authorization, the buyer authorizes the first charge at checkout and automatic monthly charges for the displayed remaining schedule. The first charge includes any down payment and the first installment. The seller pays Stripe's processing and billing fees; they are not added as a full-term fee charged to the buyer upfront.
If the seller declines a plan because its price or terms reflect an error, or because another qualifying payment reserved the domain first, the seller stops future collections and refunds the amount paid through Stripe. These payments are not held in escrow, and refund processing follows Stripe's and the buyer's bank's timing. Contact legal@namegarage.com [mailto:legal@namegarage.com] to discuss a payment problem, cancellation or an early-payoff quote.
Monthly schedules and the final payment
The agreed schedule separates the cash price, fixed payment-plan surcharge, any Easy Start surcharge and the total required to acquire ownership. A surcharge is included in the payments shown; it does not start accruing after an interest-free period. A flat surcharge is not an annual percentage rate. These descriptions do not replace any disclosure required by applicable law.
Easy Start lowers the opening payments and increases the later payments. A balloon schedule instead lowers the regular payments and leaves a larger required final payment. Where offered, a balloon schedule has no down payment, no Easy Start and no extra balloon surcharge. Its final-payment percentage is a target based on the cash price; whole-dollar allocation can increase the actual final amount. The displayed final amount, not the target percentage, is part of the agreed schedule. A bundle adds each domain's allocated schedule. The final payment is required to acquire ownership; it is not a separate optional purchase price.
Today's charge is the first payment slot, including any down payment. The first automatic payment is one calendar month after the successful first payment, clamped to that month's last day. It sets the monthly billing day for later payments. A final payment in slot 24 falls 23 monthly billing intervals after the first payment. The provider's schedule supplies the calendar dates once the first payment establishes that billing day. All required payments, including the final payment, must be confirmed before the seller reviews final ownership transfer.
The seller arranges domain access after the initial payment and verification and retains registration control until completion. Domain use must comply with law and the agreed terms. Contact the seller to arrange DNS changes, confirm registration coverage or request an early-payoff quote. No extension or refinancing is promised. A changed schedule requires new agreed terms and buyer confirmation.
Cancel an unpaid card plan
For a new card agreement that accepts this version, the buyer may cancel at any time while the purchase remains unpaid. Send a written cancellation request to legal@namegarage.com [mailto:legal@namegarage.com] from the agreement's buyer email address. The seller verifies the buyer's request and records when it was received. Cancellation takes effect when the seller receives the valid request; it does not require seller approval, a missed payment or a requestgrace period. The buyer must stop using the domain and give up any access or control supplied under the lease. The seller keeps ownership and recovers control. Cancellation does not transfer ownership to stopthe buyer.
The seller stops future collection and does not charge a cancellation fee, accelerate or collect any unpaid purchase balance, including an unpaid final payment. Payments completed before receipt of the cancellation request are retained, subject to mandatory law and the exceptions below. A charge completed after receipt is reviewed for correction or refund; it is not automatically retained and does not restart the agreement. If the available timestamps cannot establish whether payment preceded the request, that payment also requires review. Processing a request may take time, but it does not move the effective cancellation time or make later purchase payments owed.
Billing closure and domain return require the verification described below. An unresolved payment, refund, dispute or domain-control issue keeps the reservation protected for review. It does not create a right to continue collecting the unpaid purchase balance. Once full payment or a confirmed early payoff completes the purchase, ownership-transfer and payment-review procedures apply; this cancellation process cannot convert a completed purchase into retention of both the full price and the domain. Mandatory withdrawal and refund rights remain unaffected.
Pay off a new card plan early
The buyer may contact the seller for an early-payoff quote on an eligible new card plan. The quote credits confirmed payments and removes the payment-plan and Easy Start surcharges allocated to payment periods that have not started. No early-payoff fee applies. The seller shows the exact payoff amount, credited payments and fee reduction for the buyer's confirmation before payment. Unresolved missed payments, refunds, disputes or other payment issues require review before the seller can issue a payable quote.
Each domain's agreed cash price and actual surcharge amounts are frozen when the plan is accepted. Each surcharge is allocated evenly across that domain's scheduled payment periods. The first period starts when the first payment succeeds; each later period starts on its scheduled installment date. To account for cent rounding, the earned share of each surcharge is its total multiplied by the number of periods started, divided by the total number of periods, rounded half up to cents. The rest is removed from the payoff. This calculation is made separately for each domain and surcharge before adding the results. It is not daily interest or a new annual percentage rate.
The payoff equals the original total less confirmed payments and the remaining future surcharges. A down payment is credited once as part of the actual payments. The original schedule and payment history stay recorded; a fee reduction is not money received or a cash refund. Ownership transfer still requires verified payment, closure of the remaining collection paths and seller review. Existing agreements without this expressly accepted payoff basis keep their original terms.
Missed payments, notice and domain return
For new monthly card agreements accepted under this version, a missed payment, including the final payment, triggers a default notice to the buyer's agreed email address. The seller records when the sending service first accepts the notice for that installment. Service acceptance is not proof of inbox delivery. A failed sending attempt does not start the notice-based grace period. The cure deadline is no earlier than both the installment due date plus 14 calendar days and the first accepted notice plus 14 calendar days. A later missed installment needs its own notice and full grace period. The buyer can cure the missed payment before termination; contact the seller for payment recovery.
If the missed payment remains uncured after that deadline, the seller may stop collections and terminate domain use. The seller must verify that the payment schedule and any unpaid invoices can no longer collect, check payments, refunds and disputes, and confirm control of every domain before completing return and releasing the reservation. A billing cancellation or webhook alone does not prove domain return or authorize relisting. Uncertain payments or control require review.
After verified termination, the buyer loses domain use, the seller recovers control, and the seller retains prior payments subject to applicable law and the exceptions below. The seller does not accelerate, pursue or collect any remaining purchase balance, including an unpaid final payment. The original schedule and payment records remain in the agreement history; they do not establish a collectible balance after termination. Retaining prior payments is not a refund.
Payment retention does not override mandatory rights, refunds required for seller nonperformance, the price-error or competing-reservation refund above, or corrections for erroneous, fraudulent, disputed or charged-back payments. These cases require review under the applicable agreement, law and provider process. A late or duplicate payment does not restart an ended agreement and must be reviewed separately for correction or refund. Nothing here limits a buyer's right to raise a payment dispute.
These provisions apply only to new agreements that expressly accept this version and its payment authorization. Existing plans keep their agreed schedule, authorization, cancellation and payoff terms. Escrow.com transactions follow Escrow.com's own agreement and procedures, not these card-plan default rules.
8. Listing completed sales
After a sale completes, we may list the domain name, the month of the sale, the price and where it sold on namegarage.com. We never name or identify the buyer. Ask us at any time, before or after the sale, to list it without the price or not at all, and we will update the listing promptly.
9. General
Entire terms; changes. These Terms and the transaction-specific terms expressly agreed by both parties govern website pricing, approval, availability, reservations and reservationsthe listing of completed sales. Expressly agreed transaction-specific terms prevail where they differ; Escrow.com’s agreement governs its services. Together, the applicable terms supersede prior statements on these subjects for that transaction. Changes to these website Terms do not retroactively change an existing agreement. Each revision is published as a new dated version, and prior versions remain available in the version history.
